These General Terms and Conditions (‘’GTC’s’’) of Ascent for customers will govern the contractual relationship between Ascent and any individual, who is not acting as a commercial entity, wishing to purchase the Product on the Website. To this purpose, the Customer and Ascent agree that these GTC’s will, together with the order as accepted by Ascent and the GTC’s exclusively govern this relationship. 

1. Definitions

1.1: In these GTC’s of Ascent, the following definitions apply:

Ascent:

Ascent B.V., a B.V. under the laws of the Netherlands, registered with the Dutch Chamber of Commerce under number 92062962, having its registered place of business at Sophiakade 55, 3061 DK Rotterdam.

Customer:

A natural person who is not acting for purposes related to trade, business, craft or profession.

Product:

The Ascent product(s) which can be ordered from the Ascent Website.

Party/ Parties:

Ascent and the Customer individually and collectively.

Website:

the official Ascent website, which can be found here: ascent-store.com 

2. Prices and payment

2.1: Payments on the Website can be made by any of the following methods: American Express, Google Pay, iDeal, Klara, Mastercard, Paypal and Visa.

2.2: All prices on the Website are in Euros and are inclusive of VAT and exclusive of delivery costs. Any change in the VAT rate may be applied to the Product. Prices are subject to change without explicit notice, being accepted that the price is applicable to any order that is the price indicated on the Website at the time of submitting your Product order.

2.3: The amount payable by the Customer to Ascent for an order will be the total of the following amounts:

a: The total price of the Product(s) ordered as indicated on the Website at the time of submitting the order plus;

b: The cost of delivery which are determined in accordance with the Delivery (article 3). 

3. Delivery

3.1: The Customer will be charged Delivery costs. The amount will depend on the delivery option, the weight of the package and on the country of destination.

3.2: Deliveries can be made within Belgium; Bulgaria; Denmark; Germany; Estonia; Finland; France; Greece; Hungary; Ireland; Italy; Croatia; Latvia; Lithuania; Luxembourg; Netherlands; Austria; Poland; Portugal; Romania; Slovenia; Slovakia; Spain; Czech Republic; Sweden.

3.3: Ascent will deliver the Products in accordance with the delivery option selected by the Customer. Whenever referred to working days, this excludes Saturday, Sunday and public holidays.

3.4: If, after ordering your Product you want to cancel your order, the Customer can within reasonable time exercise its statutory right of cancellation in accordance with article 5 below.

3.5: If you want to return your product after delivery of the Product(s) the Customer can, within reasonable time, exercise its statutory right to return or exchange the Product(s) in accordance with article 5 below. 

4. Product quality

4.1: Ascent will make its best efforts so that the photographs of the Product(s) is/ are as good as possible. However please note that in the representation of the Product as reproduced from your screen may differ from the exact Product. 

5. Returns, exchange and cancellations

5.1: Only if a Product is purchased on the Website, the Customer can cancel, return or exchange the Product in line with the conditions laid out in this article for a refund or another Product(s). A Product(s) purchased in retail stores (ascent-store.com/map) must be returned or exchanged in that respective retail store and in accordance with the retail store’s respective return policy.

5.2: The Customer has a legal right to cancel an order within 14 days as from the delivery date of a Product.

5.3: The Customer must notify Ascent that it wants to cancel the order and receive a refund. This can be done by completing the Cancellation Form on the Website.

5.4: If you return your order within 14 days as from the delivery date of the Product:

a: Then you must return it to Ascent without undue delay (in unused condition and in the original Product packaging) and in any event not later than 14 days after the day on which you successfully submit the Cancellation Form;

b: Customers wishing to return Products are responsible for any labelling and packaging guidelines produced by the national post or any other courier that is used to return the Product(s) properly;

c: If sending by post Ascent recommends you to obtain proof of postage as Ascent does not accept responsibility for Products lost in transit.

5.5: Ascent will refund you the price you paid for the Product, although, please note Ascent may reduce your refund to reflect any reduction in the value of the Product(s) if this has been caused by you handling the Product(s) in an inappropriate way.

5.6: Ascent will make any refunds due as soon as possible and in any event within 14 days after the day Ascent receives the notification that you cancelled the order.  Ascent will refund you on the credit card or debit card used by you to pay the order. If you used vouchers to pay for the Product Ascent shall refund you in vouchers.

5.7: If you cancel your order but do not send off such Product to Ascent within 14 working days of notifying Ascent of cancellation, Ascent shall be entitled to withhold payment of any refund.

5.8: The Customer’s right to return a Product does not apply to a Product(s) (i) made to the Customers specification; or (ii) which have been clearly personalized or (iii) which by reason of their nature cannot be returned or are liable to deteriorate or expire rapidly or (iv) where sealed Product have been supplied which are not suitable for return due to health protection or hygiene reasons, if they become unsealed after delivery.

5.9: If you want to exchange your Product(s) for another Product(s), you can indicate this on the Cancellation Form. Conditions relating to the return of the Product(s) you want to exchange will be according to article 5.3 and 5.4. On the Cancellation Form you will be able to indicate that you would like to exchange your Product(s) and which Product(s) you want instead. The delivery costs will be for the Customer’s cost and will be charged when you indicate this option on the Cancellation Form. 

6. Liability

6.1: The Customer should only use the Product for what the Product is intended to do. The user instructions on the Website must be followed. No liability is accepted for deviating use. 

6.2: Ascent can only be held liable for damage the Customer suffers insofar as that the damage is caused by intent or willful recklessness on Ascent’s part. Any liability on Ascent’s part expires in full 6 months after the date on which the damage has occurred. 

6.3: If it is determined that Ascent is liable for any damage, it is only liable for direct damage resulting from or related to the performance of an order. Liability for indirect damage and consequential damage is excluded. Ascent’s lability is also limited to a maximum of the purchase price of the relevant Product.

6.4: If Ascent is delayed or hindered in or prevented from performing any of its obligations under any order by reason of any event or circumstance beyond its reasonable control, Ascent will have no liability to the Customer in respect of such non- performance and the time for performing the same will be extended until the event or circumstance has ceased.

6.5: Ascent only supplies Products for private use. The Customer hereby agrees that it will not use the Product for any commercial, business or resale purpose and Ascent has no liability to the Customer for any loss of profit, loss of business, business interruption, or loss of business opportunity. 

7. Questions and complaints

7.1: If you have any questions about the product, your order, these GTC’s or wish to contact us to complain about any matter in regard to the Product and/ or the service of the Ascent Product, please email Ascent or write us at: 3061 DK 55. 

8. Amendments and disputes

8.1: Ascent has the right to amend these GTC’s from time to time. The amendments brought to these GTc’s will be applicable to any order registered after the amended GTC’s are online on the Website. 

9. Governing law

9.1: These GTC’s are governed by Dutch law and any dispute or claim arising out of or in connection with their interpretation or execution will be subject to the jurisdiction of the Dutch courts, provided it is acceptable under applicable laws;
